Terms and Conditions

These Terms and Conditions ("Terms") are a legal agreement between you and Biz Diva Media LLC, a Virginia limited liability company doing business as GenXella ("GenXella," "we," "us," or "our"). They govern your access to and use of the website located at genxella.com and any subdomains (the "Site"), and your purchase and use of our digital products, quizzes, workbooks, downloads, and related content (collectively, the "Products").

By using the Site or buying a Product, you agree to these Terms. If you do not agree, please do not use the Site or purchase our Products.

1. Who we are and how to reach us

The Site and Products are operated by Biz Diva Media LLC (DBA GenXella). You can contact us at hello@genxella.com.

2. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Site or buy a Product. By using the Site, you represent that you meet these requirements.

3. The Products are tools, not professional advice

Our Products are self-guided informational and organizational tools. They are provided for general educational and personal use only. They are not, and are not a substitute for, professional medical, legal, financial, tax, mental health, or other professional advice. Using a Product does not create any professional-client relationship between you and us.

You are responsible for your own decisions. Before acting on anything contained in a Product, you should consult a qualified professional who can consider your specific situation. This is described further in our Disclosures and Disclaimers, which are incorporated into these Terms by reference.

4. License to use the Products

When you purchase a Product, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to download and use that Product for your own personal, non-commercial use.

You may print or save copies for your own use. You may not:

• resell, sublicense, rent, lend, or redistribute the Product;
• share, post, or upload the Product to any file-sharing, membership, or public platform;
• reproduce the Product to create a competing or derivative product; or
• remove or alter any branding, watermark, copyright, or other proprietary notice.

We retain all right, title, and interest in and to the Products and the Site, including all text, design, graphics, logos, layouts, and code. These Terms do not transfer any ownership to you.

5. Orders, pricing, and payment

Prices are shown on the Site and may change at any time before you buy. The price that applies to your order is the price displayed at the time you complete checkout.

Payments are processed by third-party payment processors (for example, Stripe). We do not collect or store your full payment card details. Your use of a payment processor is subject to that processor's own terms and privacy practices. You agree to provide accurate, current, and complete purchase information.

6. Delivery of digital Products

Products are delivered electronically, by download link, email, or access to a hosted file, typically immediately or shortly after your payment is confirmed. You are responsible for having a device and software capable of opening the Product (for example, a current PDF reader). If you do not receive your Product, contact us at hello@genxella.com and we will help you get access.

7. Refunds

Because the Products are digital goods delivered instantly, all sales are final and refunds are generally not provided. Our full policy, including limited discretionary exceptions, is set out in our Refund Policy, which is incorporated into these Terms by reference.

8. Free quiz, email list, and communications

We offer a free quiz and other free resources in exchange for your email address. By providing your email, you agree that we may send you your results, related resources, product information, and marketing emails. You can unsubscribe at any time using the link in any email. How we handle your information is described in our Privacy Policy.

9. Third-party links and services

The Site and Products may contain links to third-party websites, tools, or services, including affiliate links. We do not control and are not responsible for the content, products, policies, or practices of any third party. Following a link is at your own risk, and any dealings you have with a third party are solely between you and that third party. See our Disclosures and Disclaimers for information about affiliate relationships.

10. User conduct

You agree not to use the Site or Products in any unlawful way, to infringe anyone's rights, to interfere with the operation or security of the Site, or to attempt to gain unauthorized access to any system or account. We may suspend or terminate your access if you violate these Terms.

11. Disclaimers of warranties

To the fullest extent permitted by law, the Site and Products are provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site or Products will be accurate, complete, current, uninterrupted, error-free, or that any particular result will be achieved from using them. Results depend on your own circumstances, effort, and follow-through.

12. Limitation of liability

To the fullest extent permitted by law, in no event will Biz Diva Media LLC, its members, employees, or contractors be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or related to your use of the Site or Products.

To the fullest extent permitted by law, our total aggregate liability for any claim arising out of or related to the Site or a Product will not exceed the amount you actually paid us for the Product giving rise to the claim, or twenty-five U.S. dollars (USD 25.00) if you paid nothing.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages, so some of the above may not apply to you.

13. Indemnification

You agree to indemnify and hold harmless Biz Diva Media LLC and its members, employees, and contractors from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your misuse of the Site or Products, your violation of these Terms, or your violation of any law or third-party right.

14. Changes to the Products, Site, or Terms

We may modify, suspend, or discontinue any part of the Site or Products at any time. We may also update these Terms from time to time. When we do, we will change the effective date above and post the updated version on the Site. Your continued use of the Site after changes take effect means you accept the revised Terms.

15. Governing law and dispute resolution

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms, the Site, or the Products will be brought exclusively in the state or federal courts located in Virginia, and you consent to the personal jurisdiction of those courts, unless applicable law gives you the right to bring a claim elsewhere.

16. Miscellaneous

If any provision of these Terms is found unenforceable, the remaining provisions will stay in effect. Our failure to enforce any provision is not a waiver of that provision. These Terms, together with the Privacy Policy, Refund Policy, and Disclosures and Disclaimers, are the entire agreement between you and us regarding the Site and Products.
